Like a plot twist straight out of House of Cards, the plaintiff claiming to have been sexually assaulted by Kevin Spacey has died, according to a notice filed in court by the actor’s attorneys today.
According to The Hollywood Reporter: “The individual, suing as a “John Doe,” filed claims in September 2018 with the allegation of being forced to grab the actor’s genitals twice during a massage two years earlier at a private residence in Malibu. In May, a federal judge in California allowed the case to move forward despite Spacey’s objection that the plaintiff’s identity was being shielded.”
Only 4 weeks ago the parties had come to a plan for proceeding in the suit that was to include prospective discovery and would have likely been a seven- to 11-day trial.
However now, in a turn eerily like a plot the ever-evil Francis Underwood would hatch, the plaintiff’s attorney has informed Spacey that the client “recently passed.”
No more information regarding the plaintiff’s sudden death in the midst of the lawsuit is available at this time according to news reports.
Adding a level of intrigue to the entire situation is the fact that criminal charges against Spacey were recently dropped in Nantucket, Mass, where Spacey had pleaded not guilty to felony indecent assault and battery. In that case, the accuser — a teenage boy — suddenly stopped cooperating., and prosecutors withdrew the charges.
But it was the current lawsuit which represented the most significant legal situation for Spacey.
Beginning in late 2017 Spacey has been accused of sexually assault improper conduct against a long list of individuals spanning decades.
According to the Hollywood Reporter: “In this case, as detailed in joint report filed in August, plaintiff’s lawyers represented to the court two other alleged masseur victims of Spacey expressing “concern for their safety and/or do not want their names revealed publicly in the media. The lawsuit could continue by the heirs of “John Doe,” though the issue of anonymity provides a complicating wrinkle. To show standing to sue, the heirs would likely have to identify the deceased accuser after getting a green light to administer his estate in probate court. A judge might also be less inclined to protect the privacy interests of the deceased. Even if the case moves forward, the loss of the most important witness to the alleged sexual assault would make it difficult to litigate.”
This marks the second person who has died in just the last 7 months in connection with accusations against Kevin Spacey.
The first whistleblower to go public with allegations branding Kevin Spacey a sexual predator is dead — and her grieving family is demanding answers.
In March 2018 investigators launched a murder probe into Linda Culkin’s mysterious death, while 59-year-old Spacey faced the now withdrawn felony charge of indecent assault and battery for allegedly groping the suddenly uncooperative young man in Nantucket, in 2016.
On Feb. 25, Culkin was walking to her home when she was mowed down by a Toyota as she stepped into a busy intersection, Quincy Police Capt. John Dougan told Radar. She later died at Boston Medical Center.
No charges were filed against the driver, who remained at the scene.
“Linda was one of the first to accuse Kevin Spacey of attacking young men, and I find it very odd that you don’t hear anything more about her accident — or about the person who hit her,” said Culkin’s cousin Cindy, 60.
“It’s like it happened, and now there is nothing!”
But Felix Browne, a spokesperson for the medical examiner’s office, said at the time, “the cause and manner of Culkin’s death is still under investigation.”
Culkin, a nursing assistant with mental problems, began cyberstalking and terrorizing Spacey and his team in 2009 after one of her young male patients told her the details of an alleged attack by the American Beauty actor.
In 2014, she was sentenced to 51 months behind bars after pleading guilty in federal court to sending harassing emails, making fake bomb threats and mailing an envelope containing white powder to Spacey’s associates.
In 2018 actor Anthony Rapp broke decades of silence to charge that the actor tried to molest him at age 14.
